While no account creation is necessary for standard transactions, users who choose to create an optional account for enhanced features are responsible for maintaining the confidentiality of their login credentials. Account holders must ensure that all information provided during optional registration is accurate, current, and complete. The platform is not liable for any loss or damage arising from unauthorized access to a user's account due to the user's failure to protect their credentials. Users must notify the platform immediately upon becoming aware of any unauthorized use of their account. The service reserves the right to suspend or terminate accounts that are found to be in violation of these terms.

4. Use of the Service

Users are granted a limited, non-exclusive, non-transferable license to access and use this exchange service solely for lawful cryptocurrency swap transactions. Violations of these prohibitions may result in immediate service termination, reporting to law enforcement, and civil or criminal liability.

7. Disclaimers

This crypto swap service is provided on an 'as is' and 'as available' basis without warranties of any kind, either express or implied. The platform does not warrant that the service will be uninterrupted, error-free, or free from security vulnerabilities, and it makes no representations regarding the accuracy, completeness, or timeliness of any information provided through the exchange interface. Cryptocurrency markets are inherently volatile, and the platform does not guarantee any particular exchange rate or that a desired rate will remain available at the time a transaction is executed. Users acknowledge that cryptocurrency transactions are irreversible and accept the associated risks. The service is not a financial advisor, and nothing on the platform constitutes financial, investment, or legal advice. Users rely on the service at their own risk and are encouraged to conduct their own due diligence before executing any transaction.

8. Limitation of Liability

This includes, without limitation, loss of profits, loss of data, loss of cryptocurrency, or any other financial losses resulting from system downtime, transaction errors, third-party failures, or unauthorized account access. The platform's total aggregate liability to any user for any claim arising under these terms shall not exceed the value of the transaction fees paid by that user in connection with the specific transaction giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, and in such cases, the platform's liability will be limited to the fullest extent permitted by applicable law. Users are encouraged to take independent steps to protect their assets, including using secure wallet software and verifying transaction details before confirmation.

9. Indemnification

Users agree to indemnify, defend, and hold harmless SimpleSwap, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses — including reasonable legal fees — arising from the user's use of the platform, violation of these terms, or infringement of any third-party rights. This indemnification obligation applies to claims arising from the user's breach of any applicable law or regulation in connection with their use of the service. The platform reserves the right to assume exclusive control of any matter subject to indemnification by the user, and the user agrees to cooperate fully with the platform's defense of such claims. If a dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration in accordance with the rules of a recognized arbitration body, unless prohibited by applicable law. Class action lawsuits and class-wide arbitration are expressly waived to the extent permitted by law. These terms are governed by and construed in accordance with applicable law, and users consent to the jurisdiction of competent courts for matters that cannot be arbitrated. 11. Termination of Access

SimpleSwap reserves the right to suspend or terminate any user's access to the service at any time, with or without notice, if the user is found to be in violation of these terms or applicable law. Termination may also occur if the platform determines, in its sole discretion, that continued provision of services to a user poses a legal, regulatory, reputational, or security risk. Upon termination, the user's right to access and use the platform ceases immediately. Because the service is non-custodial and does not hold user funds, termination does not result in the loss of cryptocurrency assets held in external wallets. The platform shall not be liable to any user for any loss or damage resulting from a termination carried out in good faith under these terms. Provisions of these terms that by their nature should survive termination — including disclaimers, limitations of liability, and indemnification — shall remain in full force and effect.

12. Changes to These Terms

This crypto swap service reserves the right to modify these Terms of Service at any time to reflect changes in its operations, legal requirements, or service offerings. When material changes are made, the platform will provide notice through prominent posting on its website and, where contact information is available, through direct communication to affected users. The effective date of the current version of these terms will be clearly displayed, enabling users to identify when updates were last made.
